In the famous words of the late President John F. Kennedy, America was challenged to lead in space, not because it was easy, but because it was hard. Last week, the private sector faced the harsh reality of space exploration when a mission to the moon, promising historic achievements, ended in failure due to technical issues with the lunar lander Peregrine.

Astrobotic Technology and United Launch Alliance's joint venture, supported by Boeing, Lockheed Martin, and Blue Origin, aimed to make history with the first American landing on the moon in over 50 years. Technical issues related to the capsule's heat shield and life support system led to the delays, underscoring the challenges of space travel.

Despite these setbacks, a new era in space exploration has begun, marked by the commercialization of space. The space economy is projected to grow significantly, reaching a value of $642 billion by 2030. The failure of current missions is seen as a temporary setback, with the increasing involvement of the private sector driving progress.

However, the surge in satellites in Earth's orbit poses challenges, with potential dangers of collisions and space debris. The European Space Agency estimates 170 million pieces of debris in orbit, emphasizing the need for effective debris monitoring and removal solutions.

As the commercial sector vies for space resources, especially on the moon, concerns arise about potential conflicts. The moon's wealth in essential materials for energy production, such as helium-3, and other resources vital for clean energy, raises the stakes in the competition among space powers.

The current space governance framework, including the UN Outer Space Treaty, is deemed outdated and insufficient to address new challenges posed by the private sector's entry into space exploration. The lack of international treaties tailored to accommodate these changes fuels differing interpretations and a lack of clear guidelines.

Countries like the United States are taking steps to assert rights over space resources, exemplified by the US Commercial Space Launch Competitiveness Act, allowing American companies to own space resources. However, this approach has sparked criticism and highlighted the need for comprehensive and updated international space laws.

As space exploration enters a new era, it is crucial to address the governance gaps, prevent the escalation of conflicts over space resources, and ensure responsible exploration that considers the interests of all nations. The entry of the private sector into space exploration without adequate regulations poses challenges that must be addressed to avoid potential conflicts and uphold the principles of space exploration as a shared human endeavor.
